Judge: Repaying Vista Links debt an ‘unenforceable moral obligation’

By Olivia Hewitt

A federal judge dismissed a lawsuit last Thursday against Buena Vista filed by ACA Financial Guaranty Corp., a bond insurer that loaned the city $9.2 million to finance the Vista Links Golf Course. U.S. District Judge Norman Moon said Buena Vista was not legally obligated to pay off its debt. Moon also said ACA has the right to seize the golf course, city hall, the police department, and the courthouse that Buena Vista posted as collateral. ACA said in a statement that it plans to appeal the ruling.
